The terms and conditions below govern your use of DOUZO services and website.  Please read the following sections carefully before you use the DOUZO website. Definitions

  • "We", "us", or "our" means DOUZO Limited.
  • "You" means the user of the DOUZO services or website.
  • "Site" or "website" means www.douzo.co.uk
  • "Personal information" means information that personally identifies you, such as your address.
  • "Content" means the information or material available on the DOUZO website.

We take all reasonable steps to ensure that the information on this website is correct.  However, we do not guarantee the correctness or completeness of material on this website.  We may make changes to the material on this website at any time and without notice.  The material on this website may be out of date, or on rare occasions incorrect and we make no commitment to ensure that such material is correct or up to date.

Service and price

When you purchase a gift list from DOUZO, you get a website on which you can list gifts and share this list with others who might want to give a gift from your list.  Features included in the cost of a standard list are personalised web address for your gift list, unlimited number of gifts per list, list open for one month after your event, secure access to your list, ability to change the gifts listed at any time.

A standard list costs £10.  A list using a customisable design template costs an additional £2 (total cost of £12). 

Delivery

When you purchase a service from DOUZO, it is available immediately after the one-off payment has been received for use of that service.  Confirmation of payment and sign-up is provided by us and also by our payment partner, Paypal.  Please ensure that you provide a valid email address.

Refunds and cancellations

DOUZO offers an irrevocable online service. When you place an order, you are responsible for understanding that, due to the nature of our business, we do not issue refunds after your order is accomplished and the service is made available.  If you do not receive an email from us confirming your purchase, we recommend contacting us.

However, if you are completely unable to use our service due to a website outage of more than 24 hours unavailability, you may make a claim for a refund based on non-delivery of the service.  This claim must be submitted in writing to team@douzo.co.uk within seven days of you placing an order and completing payment for that order. Otherwise the service will be considered received.

Limitation of liability

You assume total responsibility and risk for your use of the site and the internet.  www.douzo.co.uk provides the site and related information "as-is" and does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise, information, or service provided through the site or on the internet generally.  www.douzo.co.uk shall not be liable for any damage or cost arising either directly or indirectly from any such transaction.  It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, merchandise, and other information or service provided through the site or on the internet generally.

The relationship between the list owner and list manager is solely a matter for these individuals and wholly independent of DOUZO. DOUZO Ltd takes no responsibility for the consequences of any breakdown of this relationship nor for either party not fulfilling their responsibilities with regard to the functioning of their gift list.

Neither we nor any other party (whether or not involved in producing, maintaining or delivering this website), shall be liable or responsible for any kind of loss or damage that may result to you or a third-party as a result of your or their use of our website.  This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this website.

Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.

Internet

You understand that, except for information, products or services clearly identified as being supplied by www.douzo.co.uk, DOUZO Ltd does not operate, control or endorse any information, products or services on the Internet in any way.  Except for information, products or services identified as belonging to www.douzo.co.uk, all information, products and services offered through the site or on the internet generally are offered by third-parties that are not affiliated with www.douzo.co.uk.

You also understand that www.douzo.co.uk cannot and does not guarantee or warrant that files available for down-loading through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.  You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the site for the reconstruction of any lost data.  You understand further that the nature of the internet contains unedited materials, some of which are sexually explicit or may be offensive to you.  Your access to such materials is at your risk. www.douzo.co.uk has no control over, and accepts no responsibility whatsoever, for such materials.

Any links to third-party websites located on this website are provided for your convenience only.  We have not reviewed each third-party website and have no responsibility for such third-party websites or their content.  We do not endorse the third-party websites or make representations about them or any material contained in them.  If you choose to access a third-party website linked to from this website, it is at your own risk.  If you would like to link to this website, you may only do so on the basis that you link to, but do not replicate, any page on this website, and subject to the following conditions:

DOUZO is committed to protecting your personal information when you use our services. As part of providing our services, we have to collect some information about you. Our use of this information is described in our privacy policy

Availability

We take all reasonable steps to ensure that this website is available all day every day.  However, websites do sometimes encounter downtime due to server and, other technical issues.  Therefore we will not be liable if this website is unavailable at any time.  This website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control.  We will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

Visitor conduct

When using this website, you shall not post or send to or from this website any material:

  • For which you have not obtained all necessary consents
  • That is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom

If illegal or offensive content is reported to us, we will make every effort to remove this within 4 hours.  You accept that that we may remove any such reported content without your prior agreement and immediately terminate our agreement with you.  We will fully cooperate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of the conditions above.

Jurisdiction

This Legal Notice shall be governed by and construed in accordance with English law.  Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales. Any rights not expressly granted herein are reserved.
